What is Radiology Malpractice?

Radiology malpractice, or radiology negligence, refers to instances in which radiologists, or other medical professionals involved in the radiological process, fail to meet the applicable standard of care. In other words, radiology malpractice occurs when radiologists make mistakes that other reasonably competent radiologists would not have made in the same or similar circumstances.

When a radiologist is negligent, the patient who was relying on the accuracy of the radiology report can suffer serious harm as a result. This is because radiology reports are used by doctors to diagnose and treat patients. When a radiology report is inaccurate, a patient may receive the wrong treatment or may not receive the necessary treatment, leading to a worsened condition, new injuries, or even death.

Patients who suffer harm due to radiology errors have the right to take legal action against the at-fault radiologist and/or medical facility. These are known as radiology malpractice claims, and they are a type of medical malpractice claim.

Common Examples of Radiology Errors

Most radiology errors are caused by human mistakes. However, some errors are due to equipment malfunctions or failures, such as software glitches. In any case, radiology errors can cause delayed diagnoses, misdiagnoses, and/or a failure to diagnose a patient’s condition entirely. This can lead to a wide range of patient harm, including death.

Some examples of common radiology and imaging errors include (but are not limited to):

  • Misread X-rays: X-rays are used to help doctors identify and treat a wide range of conditions, including fractures, tumors, and infections. When a radiologist misreads an X-ray, the patient may not receive the necessary treatment in a timely manner. This can lead to a worsened condition and/or new injuries.
  • MRI mistakes: MRIs are used to help doctors diagnose and treat conditions that affect the brain, spine, joints, and soft tissues. When a radiologist misreads an MRI, the patient may suffer serious harm as a result. For example, a patient may be misdiagnosed with a brain tumor and, as a result, may undergo unnecessary and invasive surgery. Conversely, a patient may have a brain tumor that is not identified and, as a result, may not receive the necessary treatment until it is too late.
  • CT scan errors: CT scans are used to help doctors diagnose and treat a wide range of conditions, including cancer, blood clots, and fractures. When a radiologist misreads a CT scan, the patient may receive the wrong treatment or may not receive the necessary treatment in a timely manner. This can lead to a worsened condition and/or new injuries.
  • Ultrasound misinterpretations: Ultrasounds are used to help doctors diagnose and treat conditions that affect the organs, blood vessels, and soft tissues. When a radiologist misreads an ultrasound, the patient may suffer serious harm as a result. For example, a patient may be misdiagnosed with a tumor and, as a result, may undergo unnecessary and invasive surgery. Conversely, a patient may have a tumor that is not identified and, as a result, may not receive the necessary treatment until it is too late.
