Wrongful death claim arises from alleged medical malpractice

The time before the birth of a child is typically a time of excitement for expectant mothers and fathers in Texas. Those in this situation anticipate that they will leave the hospital with their new family member in tow and begin adjusting to a new normal. Unfortunately, one out-of-state family has had to cope with the loss of the baby's mother in childbirth, allegedly as a result of medical malpractice. Because family members believe the claimed wrongful death resulted from negligence, they have since filed a lawsuit against the hospital and several medical care providers.

The woman was allegedly suffering from nausea and vomiting, extreme pain and high blood pressure. Her husband and mother claim that these symptoms are all indicators of preeclampsia, a treatable but potentially fatal condition suffered by pregnant women. Despite the presence of the symptoms, it is claimed that medical care professionals did not believe she was suffering from the condition and chose not to have her evaluated at the hospital. The baby was ultimately born one month before his due date.

Family members say that the woman panicked and became combative, necessitating the use of restraints. At the time of delivery, she was unresponsive, but doctors reportedly assured family members of her recovery. Soon afterward, tests indicated that she had suffered a massive cerebral hemorrhage. Although the lawsuit claims that the tests showed there was no hope for recovery, doctors still chose to transfer her to a different hospital, where she died. Her husband and mother, who filed the lawsuit, claim that the failure to diagnose preeclampsia breached the acceptable standard of care and resulted in the woman's death.
