$35.4 million award results from doctor errors

The months leading up to the birth of a baby are filled with anticipation and joy. While many people in Texas are aware of the potential complications of childbirth, the thrill of meeting a new family member often eclipses any concerns. Unfortunately, one out-of-state woman claims that complications she experienced after the birth of her daughter were likely preventable had it not been for doctor errors made by a physician who had treated her years earlier. A jury has recently agreed with her claims.

The woman claims that in 2004 she began to experience dizziness. At that time, she sought treatment from the defendant in the case. Tests reportedly revealed brain abnormalities that should have resulted in her inclusion in a database of patients with similar issues. However, she claims the doctor failed to add her name to the database.

As a result, the doctor who delivered her baby in 2008 was unaware of her condition. That doctor claims that had the woman's condition been known, a C-section would have been performed. Unfortunately, the woman suffered a stroke several hours after delivery, leaving her in a coma for two months. Now she requires multiple caregivers and is struggling to return to a normal physical condition. A jury has recently ruled in her favor, awarding her $35.4 million.

While the vast majority of health care workers are well-trained professionals, doctor errors can have a significant, long-term impact on a person's life. As a result, people in Texas who are suffering from medical malpractice have the option of filing medical malpractice suits in civil court, as this woman has done. A successfully presented case could result in an award of damages that will allow the injured person to focus on his or her recovery and receive the medical care required without worrying about his or her financial situation.
